{"id":3590,"date":"2021-01-04T13:00:00","date_gmt":"2021-01-04T12:00:00","guid":{"rendered":"https:\/\/schaffer.isd-internet.de\/?p=3590"},"modified":"2022-11-03T11:21:52","modified_gmt":"2022-11-03T10:21:52","slug":"covid-pandemie-miet-und-pachtverhaeltnisse","status":"publish","type":"post","link":"https:\/\/schaffer-partner.de\/en\/sonderrundschreiben\/covid-pandemie-miet-und-pachtverhaeltnisse\/","title":{"rendered":"COVID-Pandemie: Miet- und Pachtverh\u00e4ltnisse"},"content":{"rendered":"<p>Die COVID-19-Pandemie besch\u00e4ftigte uns schon das ganze letzte Jahr und wird das auch noch weiterhin tun.<\/p>\n\n\n\n<p><br>Eine wesentliche Folge der Pandemie ist, dass gesetzliche \u00c4nderungen, die sonst Jahre in Anspruch nehmen w\u00fcrden, innerhalb von Wochen, zum Teil wenigen Tagen durchgepeitscht werden.<\/p>\n\n\n\n<p><br>So hat ein Beschluss der Bundesregierung und der Ministerpr\u00e4sidenten vom 13.12.2020 dazu gef\u00fchrt, dass am 17.12.2020 (!) ein Gesetz in Kraft getreten ist, das wesentliche Erleichterungen f\u00fcr ganz besonders von der Pandemie betroffene Unternehmer, insbesondere f\u00fcr Gastronomen und Einzelh\u00e4ndler, bietet, soweit diese ihre Gesch\u00e4fte in gemieteten R\u00e4umlichkeiten betreiben.<br><\/p>\n\n\n\n<p>Nach diesem Gesetz stellt die COVID-19-Pandemie oder besser die staatlich angeordneten Schlie\u00dfungen und Fl\u00e4chenreduzierungen eine schwerwiegende St\u00f6rung der Gesch\u00e4ftsgrundlage des Miet- bzw. Pachtverh\u00e4ltnisses dar.<br><\/p>\n\n\n\n<p>Dies hat zur Folge, dass der Mieter bzw. P\u00e4chter einen Anspruch auf Neuverhandlung der Miet- und Pachtzahlungen f\u00fcr den Zeitraum der Beeintr\u00e4chtigung hat.<br><\/p>\n\n\n\n<p>F\u00fcr die betroffenen Unternehmer kann dies im Einzelfall eine ganz erhebliche Erleichterung darstellen; f\u00fcr den Vermieter u.U. aber eine erhebliche Belastung. Die Belange beider Seiten sind abzuw\u00e4gen.
